Use of Site
The services of the Site are available only to
individuals who can form legally binding contracts under
applicable law, and thus, are not available to minors. By
using this site, you represent that you are of sufficient
legal age to use this site and to create binding legal obligations
for any liability you may incur as a result of the use of

Use of this site also warrants that the user is legally
authorized to make the travel reservations or purchases
made for either himself or herself or for another person
for whom he or she is authorized to act. The user also agrees
to the payment of all amounts when due, including additional
taxes and fees that may not be included in the quoted rate,
and compliance with all rules regarding the availability
of rates, products or services to include penalty fees arising
from the failure of the purchaser to comply with said rules.
User shall also agree to pay all duties, taxes, and related
charges arising out of its use of this Site and of the services
provided herein. User also agrees to allow Condo Saver to
charge the credit card upon processing the reservation for
services rendered.
You may only use this site to make legitimate reservations
or purchases and shall not use this site for any other purposes,
including without limitation, to make any speculative, false
or fraudulent reservations, or any reservation in anticipation
of demand.
Privacy and Use of Personal Information
You are in complete control of the information
you provide to the Site and/or its various third party providers
and distributors for your travel planning needs. This Site
and/or its various third party providers and distributors
respects and will continue to respect the privacy of members
who use this Site.
When you reserve or purchase travel services
through the Site, information about you is provided to the
hotel or other involved third party to ensure the successful
fulfillment of your travel arrangements.
Please be aware that the Site contains links to other web
sites that may collect personally identifiable information
about you. When you click on one of these links, you are
entering another web site for which Condo Saver has no responsibility.
Furthermore, our Privacy Policy does not cover the information
practices or policies of such web sites. We urge you to
read the privacy policies of all such sites, as their policies
may be materially different from this Privacy Policy.
Information Disclosure
In addition to the circumstances described above, we may
disclose information if required to do so by law, court
order, as requested by other government or law enforcement
authority, or in the good faith belief that disclosure is
otherwise necessary or advisable including, without limitation,
to protect our rights or properties when we have reason
to believe that disclosing the information is necessary
to identify, contact or bring legal action against someone
who may be causing interference with our rights or properties,
whether intentionally or otherwise, or when anyone else
could be harmed by such activities.

Information Safeguards
All information you provide to us is transmitted using SSL
(Secure Socket Layer) encryption. SSL is a coding system
that lets your browser automatically encrypt, or scramble,
data before you send it to us.
Advertising Disclosure
Property descriptions and related information posted on
our pages are the representations of our suppliers. Condo
Saver is not responsible for typographical, pricing, product
information, or pricing errors. Advertised prices and available
quantities are subject to change without notice.
Exclusive Negotiated Discount Rates
Simply put, these are the lowest rates we offer. Because
of our buying power, we are able to negotiate wholesale
rates from the hotels directly. We pass these savings along
to you, the consumer. These rates can not be found anywhere
else online. To secure your reservation, we require payment
to be made in full for these bookings. This ensures you
have a room when you arrive so you are not overbooked.
Rates may be based on the number of persons occupying a
room. Additional persons in the room may cause the hotel
to change the rate confirmed.
Taxes are included in the rate requested for these properties.
Taxes are displayed on the Hotel Reservation page and are
added to the total.
Hotel Requests for specific features such as bedding type
or non-smoking rooms are requests only, and while most hotels
will strive to honor your requests, Condo Saver cannot guarantee
that your request will be honored.
Hotels change pet acceptance policies often and without
notice. It is very important that you confirm directly with
the property that they do, indeed, accept pets. We accept
NO RESPONSIBILITY for an individual property's pet policy.
You will be paying for the basic room rate and applicable
taxes at the time of confirmation. A credit card charge
will appear on your next statement from Hotel Hotline.com.
Any incidental charges such as meals, or phone calls, must
be paid directly to the hotel at the time of check-out.
You may be required to present a credit card at check-in
to guarantee payment of these incidental charges.
Reservations of Exclusive Negotiated Discount Rates will
apply a $25.00 cancellation fee regardless of the timeframe
of cancellation. This fee is subject to change without notice.
Please read the Check-In and Cancellation Policies portion
of the Booking Form for a detailed cancellation policy.
If the cancellation is outside of the time allotted, you
may be charged for one night's stay.
Additional Discount Rates
Through various third party suppliers, Hotel Hotline
is able to offer you additional discount rates for select
properties. These rates are provided to us via a partnership
with one or more suppliers. Taxes are included in the rate
requested for these properties. Taxes are displayed on the
Hotel Reservation page and are added to the total.
You will be paying for the basic room rate
and applicable taxes at the time of confirmation. A credit
card charge will appear on your next statement from a third
party provider. Additionally, a convenience fee will be
assessed upon the processing of the reservation. This fee
is non-refundable, and may be changed at any time. Please
make sure to read the Handling Methods portion of the booking
form to calculate the convenience fee associated with your
reservation. A credit card charge will appear on your next
statement from Hotel Hotline.com.
Other Hotel Reservations
Other hotel property reservations are accepted
without pre-payment. Your credit card account number is
passed to the hotel property to guarantee your reservation
for late arrival. You must cancel your reservation within
the guidelines of the hotel property to avoid no-show fees.
The only fee you incur at the time of reservation is the
Convenience fee. A credit card charge will appear on your
next statement from Hotel Hotline.com.
Rates displayed are base rates per room per night. Hotel
taxes are NOT included in the rate requested. Additional
persons in the room may cause the hotel to change the rate
confirmed.
Individual hotels, properties and/or suppliers may assess
certain charges to your credit card for cancelled reservations.
If this Site has not provided the hotel's specific cancellation
policy, please check directly with the property to understand
their cancellation policy.
Some rates have special requirements such as AAA membership
or Senior Citizen proof of age at check-in. Verify that
you qualify for the rate that you have booked. Hotel properties
are not obligated to honor this rate if you do not qualify.
Denial of Access
In its sole discretion, in addition to any other rights
or remedies available to Condo Saver, and without any liability
whatsoever to User, Condo Saver, at any time and without
notice, may terminate or restrict user's access to this
Site's travel services and the services therein.
Assignment
You may not assign, convey, subcontract or delegate your
rights, duties or obligations hereunder.
Additional Terms
Additional Terms of Service may apply to reservations, purchases
of goods and services and other uses of portions of this
site, and you agree to abide by such other Terms of Service.
Severability
These Terms of Service shall be deemed severable. In the
event that any provision is determined to be unenforceable
or invalid, such provision shall nonetheless be enforced
to the fullest extent permitted by applicable law, and such
determination shall not affect the validity and enforceability
of any other remaining provisions.
Modification
Condo Saver may at any time modify these Terms of Service
and your continued use of this site will be conditioned
upon the Terms of Service in force at the time of your use.
Accordingly, you agree to review these Terms of Service
periodically, and your continued access, or use on this
site shall be deemed your acceptance of the changed terms,
conditions and notices.
Exclusion of Warranty
Condo Saver, AND ANY THIRD PARTY PROVIDERS AND DISTRIBUTORS
MAKE NO WARRANTY OF ANY KIND REGARDING THIS SITE AND/OR
ANY MATERIALS PROVIDED ON THIS SITE, ALL OF WHICH ARE PROVIDED
ON AN "AS IS" BASIS. Condo Saver AND ANY THIRD PARTY PROVIDERS
AND DISTRIBUTORS DO NOT WARRANT THE ACCURACY, COMPLETENESS,
CURRENCY OR RELIABILITY OF ANY OF THE CONTENT OR DATA FOUND
ON THIS SITE AND SUCH PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES
AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND
NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE
IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE.

OTHERWISE ARISE FROM THE COURSE OF DEALING BETWEEN THE PARTIES
OR FROM ANY USAGE OF TRADE. Some states do not allow the
disclaimer of implied warranties, so the foregoing disclaimer
may not apply to you. This warranty gives you specific legal
rights and you may also have other legal rights that vary
from state to state.
Limitation of Liability
WE ASSUME NO RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR,
ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR COMPUTER
EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO,
USE OF, OR BROWSING IN THIS SITE OR YOUR DOWNLOADING OF
ANY MATERIALS, DATA, TEXT, IMAGES, VIDEO OR AUDIO FROM THE
SITE. IN NO EVENT SHALL Condo Saver OR ANY THIRD PARTY PROVIDERS
AND DISTRIBUTORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM,
DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL
OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT
LIMITED TO LOST PROFITS OR LOST SAVINGS), WHETHER BASED
IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, WHICH
ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (A) ANY USE
OF THIS SITE OR CONTENT FOUND HEREIN, (B) ANY FAILURE OR
DELAY (INCLUDING, BUT NOT LIMITED TO THE USE OF OR INABILITY
TO USE ANY COMPONENT OF THIS SITE FOR RESERVATIONS OR TICKETING)
OR (C) THE PERFORMANCE OR NON PERFORMANCE BY Condo Saver,
OR ANY THIRD PARTY PROVIDERS AND DISTRIBUTORS, EVEN IF SUCH
PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO
SUCH PARTIES OR ANY OTHER PARTY. This limitation of liability
shall apply regardless of whether the claim asserted is
based on contract, negligence, or any other theory of recovery.
Indemnification
You agree to indemnify and hold Condo Saver and its subsidiaries,
affiliates, officers, directors, agents and employees harmless
from any claim or demand, including reasonable attorney's
fees, made by any third party due to or arising out of your
breach of this agreement or the documents it incorporates
by reference, or your violation of any law or the rights
of a third party. Condo Saver's failure to act with respect
to a breach by you or others does not waive its right to
act with respect to subsequent or similar breaches.
Governing Law
This Agreement and its performance shall be governed by
and construed in accordance with the laws of the State of
New York, United States of America, without regard to its
conflict of law provisions. You consent and submit to the
exclusive jurisdiction and venue of the state and federal
courts located in the State of New York, United States of
America, in all questions and controversies arising out
of your use of this site and this Agreement. If any provision
of this agreement is held to be invalid or unenforceable,
such provision shall be struck and the remaining provisions
shall be enforced.
Entire Agreement
These Terms of Service, together with those incorporated
herein or referred to herein constitute the entire agreement
between us relating to the subject matter hereof, and supersedes
any prior understandings or agreements (whether oral or
written) regarding the subject matter, and may not be amended
or modified except in writing or by making such amendments
or modifications available on this site.
